B&Q Are They Right or Am I Correct?

My wife saw an item which had been reduced and we bought it.

It was a potting table which had been reduced to£4 and was free delivery.

We bought it and this is the crucial part B&Q took the money from our account.

Am I correct in understanding once the money has been taken its a legal transaction and B&Q have to honour the sale.

I'm asking as B&Q have realised there mistake and cancelled the sale and doing refunds by tomorrow allowing B&Q to keep our money for longer earning them interest at the same time.

Happened to me several times, once or twice with B&Q. I guess they will have a get out in the terms and conditions. It can be disappointing but when we are buying clearance I just accepted you can not win them all, tomorrow is a new day and a new bargain is waiting. I do get concerned when a company does it with large value items and takes a long time to refund, customer service these days often gives little confidence.

that doesnt seem right at all, i guess they're being petty rather than honouring the purchase and accepting any mistake.

I’ve had the same happened with different companies don’t know the laws on it I just assumed they had the right to cancel anytime before dispatch

I’m assuming B&Q have checked their terms and conditions. I had something similar with Homebase, there was an error on the website and they refunded me and sent a discount code with an apology.

Reckon their small print has something in their T &Cs. Some time back, I saw a price glitch on a summer house with a catalogue firm. They cancelled of course so I told them to close the account. However, the credit check remained. After a formal complaint, they removed it and offered 20% off my next order. Didn't shop again with them. That's the trouble with these price glitches, they can get away with not honouring them. Worst that will happen to them is you can fight for a refund and you can leave a review x

The Price advertised on the product(mistake or not)is the price you paid and the monies they willing accepted by which reckoning you are almost unquestionably the one in the right Stuart. I have had this one out in supermarkets about wrongly labelled goods many times. The onus is on them to honour the sale as promoted. Consumer rights apply. If you have a receipt that will prove handy I am sure.

I'm sure most places suggest the contract starts when the goods have left them, either from being collected or dispatched for delivery. I also believe not gives you the option or cancel before that happens too

Unfortunately B&Q are correct and are perfectly within their rights to cancel the order, especially as it's an on-line transaction, if they had made the same error in store and took your money, they could not ask you to return the item or pay the deficit.

There's two ways about it:

1) They could honor it.

2) Cancel and refund because it was an error.

So, there's always a 50/50 chance it may or may not work out.

I think the clue is in the word, mistake. They haven't tried to decieve people, rather just made an error which they are entitled to correct once they are aware of it, it's then their choice if they honour the sale or cancel it
