The government are now proposing that someone caught not wearing a seatbelt would get 3 points and possibly a ban

3 points is a bit excessive especially if your on your own but if endangering passengers there might be a case

Its the drivers responsibility to make sure the passengers wearing the seatbelt otherwise the driver gets the fine

If you are concentrating on the road and not looking at the passenger and they take the belt off and the police see it at that moment then they will still fine the driver

That would be unfair , especially if you were banned also

Whats that W, that the driver should be penalised for the passengers actions ?

The passenger should be the one fined if he stupidly removes his belt while you are driving , surely ?
