Ebay Complaint Advice

I sold a Roberts radio on ebay last July (I had won it but didn't need it).

The buyer contacted me this morning saying it doesn't work anymore and he wants a refund or he'll complain to ebay. Apparently I had listed the wrong model PLAY-T1 instead of PLAY-T2 (or the other way around) by mistake but he said he didn't mind at the time but he does now as the radio does not work, and he wants a refund. He could have returned it right away as it was the wrong model but he decided to keep it and now, 7 months later, he complains....

What do you think I should do? Can ebay find me accountable so long after the purchase?

Ebay give buyers 30 days to make a claim and i think you get 6 months protection via paypal. If you sold it 7 months ago the buyer wont be able to make a claim. If you accidentally listed the wrong model and the seller wasnt happy he should of contacted you within the first few days to tell you and then you could of sorted it out. The fact that he kept it for 7 months means that he was indeed happy with it. Just write back and tell him your sorry it no longer works and you would advise calling the manufacter to see if it can be repaired or whatever but you didnt sell it with a warranty and that if he wasnt happy with the prouduct he should of contacted you when it arrived for a refund. Ebay and paypal wont do anything for something a private seller has sold 7 months ago.

KirsteyJames is right, the Consumer Rights Acts 2015 limits the return of secondhand goods to 30 days, so they have no chance of getting a refund from anyone.

As for the listing, some posts on ebay automatically default to what they think it should be and you can't always change it. For instance, I was going to sell a bridge camera, put in all the details and it was just as I checked the post, I noticed it had changed to a different model with an entirely different spec and I couldn't edit it. Contacted ebay and they basically said tough don't sell. Good luck with your sale, the law is on your side

Thanks Dilligaf. Yes it's what happened I think, both radios looked the same so I didnt spot the model number was incorrect

This person is just looking for an excuse to get a refund! Sometimes things just stop working! Did he give you feedback at the time? Ebay will not entertain this complaint, should he make it. Don’t worry.

I would reply politely and state that after seven months, you are not liable. Don’t get in to any further communication with him.

Thanks gerrykelly25. Glad you all agree and I won't be liable. I wouldn't dream of asking for a refund on something I bought months and months ago! I was a bit shocked when I received the email.

I'm glad you've got the correct advice from members for your query. Just a tip for anyone who has a question that doesn't appear to be answered on ebay's site - put a question to the community forum. They are very savvy ebayers that willingly answer questions and you don't have to wait for days to get replies. They talked me through a problem last year when I didn't think I had any redress at all (and certainly no help from ebay) to a positive conclusion.

You are within your rights not to accept item back and refund they already had over 30days to return
